Mitchener eligible for transition program

GREENCASTLE -- Putnam County Circuit Court Judge Matthew Headley has 45 days to decide whether or not to release a Roachdale woman serving a prison sentence for stealing from a local special education cooperative into a community transition program.

Tammy Y. Mitchener, 34, was sentenced on July 23, 2009 after being found guilty of stealing more than $56,000 from Old National Trail, where she was employed as a treasurer. She was given a five-year sentence, with three years to be executed and two years to be spent on probation.

Mitchener was convicted on one count of Class C felony corrupt business influence and one count of Class D felony theft. She has been serving her sentence at the Indiana Women's Prison in Indianapolis. The Indiana Department of Correction website lists her earliest possible release date as Jan. 21, 2011.

Should she be released into a DOC Community Transition Program, Mitchener would still technically be a DOC inmate.

"She is eligible for the program now, but we're waiting on the judge's approval or denial," said CTP representative Cindy Carter. "She could either be put on home detention or work release."

Carter said it would likely be late October before any decision on the matter was made.

On Nov. 4, 2009, Mitchener's attorney, Bob Perry, filed a request on behalf of his client, asking that her place of incarceration be changed from prison to home detention.

An objection to the request was filed the next day by Putnam Count Chief Deputy Prosecutor Justin Long, and Headley denied the request on Nov. 17.

Mitchener was initially arrested on Dec. 2, 2008. She bonded out of jail the same day, and did not serve any jail time until she was sentenced.

According to court records, Mitchener wrote $56,639.19 worth of checks from the ONT's account to a vendor called PC Technologies, which turned out to be a dummy corporation she set up and opened a bank account for.

Mitchener deposited the checks she wrote into the PC Technologies account and then moved the money into her personal account, which was at a different bank, using online banking services.

  • When you are too easy on these people they do it again because the time doesn't match the crime. I have noticed that when any amount of drugs are involved they do 3 times as much time. Don't get me wrong I am not in favor of drugs but these druggies most of the time only hurt themselves whereas people like Mitchener hurt others because of greed and making money the easy way, BY TAKING FROM SOMEONE ELSE!!

  • She should have to serve the full sentence in prison. Home detention should not be an option. Her children are the ones I feel sorry for they will never live down her stupidity!!! She is a money hungry horrible person!! No amount of money is worth being put in prison and missing out on your children's lives. LEAVE HER THERE AND LET HER ROT!!!!

  • This is what ignorance does, and i quote, "Let

herrot in jail." In the rest of the US this would really be considered a rather petty crime and zero jail time would be sentenced.Instead placed on probation, forced to find gainful employment, and finally agree on a payment plan plus penalties until all the money is re-couped.

Don't you get it? It costs you, me, us $30k a year to incarcerate criminals. Plus when she gets put on home detention she pays a portion of her salary to the county also, pumping more money into the local economy.

Incarcerating criminals like Mrs. Mitchner is ludacris and I guarantee she will be out in 45-days working and getting square with the company whe duped 54K. Wake up Putnam County, its 2010. And you get your name tatooed in media history for a DUI? No wonder college grads flee upon completion of their education. Who hasn't driven after having a few? Yeah right.....YES YOU HAVE

  • Not sure what happyexPCguy is ranting about toward the end?? BUT, the fact is Tammy is costing taxpayers money right now. My personal opinion is that anyone who robs $$ from a business or person should be made to work in Jail or Prison and all of that $$ go to pay back. They should be released after they have paid back that amount. There are plenty of jobs out there that you can do online and apparently Tammy knows what she is doing online.. Or find some roadwork or similar that can pay and let the inmate decide when they get out by how many hours they want to put in. On a normal salary or income a woman with little to no education can make $18 - $25k/year, well there you go! Just an idea.. Why is it that she keeps asking out early like a spoiled child instead of saying... look kids mommy did wrong and I am not going to ask for a leanient Judge to give me special treatment, I am going to serve my sentence and then in retribute work hard now and later to make it up to all of the people I hurt!!! ?

  • In response to happyexpcguy- Why would we want someone that will steal from innocent people in our community? Who is going to hire her? I agree she should have a job in prison that all the pay goes to paying back what she stole.

In response to the comments about her asking to get out early like a spoiled child- Well let's think about it, her husband worked hard and she had all her needs met. Her children were well taken care of. She didn't steal because she needed to in order to provide for her family. She stole so that she could buy herself more coach purses, and clothes!!!! I agree she needs to grow up and show her children how to be a responsible adult and pay for her mistakes. Have her get a job in prison and start paying back she doesn't deserve to be in the community so that she can embarass her children anymore than she already has!!!!
