Cherry trial on recess until Monday morning

The jury trial of the first of four men charged in an April 2017 home invasion is on recess until Monday, June 18.

The trial of Justin Cherry, 29, of Indianapolis, began on Monday, June 11 and continued for two days until recess was called on Wednesday morning.

The prosecution has rested its case against Cherry, who faces nine felonies, including Level 1 felony burglary, Level 2 felony burglary and conspiracy to commit burglary and six more Level 3 and Level 6 felonies including armed robbery, criminal confinement and theft.

One of Cherry’s original charges of Level 3 felony armed robbery was dismissed prior to the trial.

Cherry and three other men, 29-year-old Paul Reese, 32-year-old Charles Maybaum and 20-year-old Daltyn Randolph, are all charged with multiple felonies for their alleged involvement in the robbery of the Madison Township home of Terry and Pat McCarter.

At this point, Reese, Maybaum and Randolph are all set for jury trials in the coming months.

Earlier this week, the court reset the trial of Reese to July 16, one week later than reported recently.

Maybaum is set to go on trial on Aug. 8, followed by Randolph on Aug. 20.

Cherry’s nine charges could carry a total sentence of more than 150 years, while the other three men could face even stiffer penalties for their 14 felony charges.

Although these are Putnam Circuit Court cases, they are being tried in the courtroom normally occupied by Putnam Superior Court, as it has a jury box.
