Suit asks who should get money from Dome

INDIANAPOLIS (AP) -- An Indianapolis law firm has filed suit to prevent money from an online auction of RCA Dome memorabilia from going to the Indianapolis Colts Foundation and the Indiana Sports Corp.

The plaintiffs say proceeds from the sale of public property should go to taxpayers rather than to the two private nonprofit organizations.

"This has a lot of people outraged that they are selling off public property, and none of it is going to benefit the taxpayers. It's a violation of the law," said Paul K. Ogden, an associate at Roberts & Bishop, which filed the complaint Monday in Marion Superior Court.

The lawsuit seeking class action status was filed against the Marion County Capital Improvement Board, which owns and manages the stadium.

Barney Levengood, executive director of the improvement board, said a copy of the lawsuit had been received by the board.

"We don't comment on any pending litigation," Levengood said. "I can assure you our legal counsel is reviewing it."

The lawsuit seeks to return the money to taxpayers, perhaps to help pay off the portion of public debt that remains unpaid on the Dome, Ogden said.
