Robinson withdraws petition

GREENCASTLE -- An Indianapolis woman convicted in May of trafficking with an inmate at the Putnamville Correctional Facility has withdrawn a petition to modify her sentence.

Tonya Denise Corley Robinson, 35, was given a 10-year prison sentence on May 28. Putnam County Circuit Court Judge Matthew Headley gave Robinson seven years at the Indiana Department of Correction with three years executed and four years suspected on a Class C felony charge of trafficking with an inmate. Additionally, Headley gave Robinson a three-year executed sentence for Class D possession of marijuana, which he ordered would run concurrent to the other sentence.

In October, Robinson filed a petition to modify her sentence. The state filed an objection to the petition several days later.

On the day of her hearing, after she had been transported back to Putnam County from the Madison Correctional Facility to attend a hearing on the petition, Robinson orally withdrew it.

Headley vacated the hearing and ordered that Robinson be returned to the DOC.

Robinson was arrested Dec. 30, 2008 after attempting to pass drugs and other contraband of an inmate at Putnamville during a visit, court records said.

Robinson's bond was set at $15,000 cash only. Two requests for bond modification were denied, and she served 149 days at Putnam County Jail before she was sentenced.

Originally, Robinson was also charged with Class B felony dealing in cocaine, Class D felonies dealing in marijuana and possession of cocaine and Class A misdemeanor trafficking with an inmate. Those charges were dropped under the terms of a plea agreement.

Before she accepted that deal, Robinson rejected an agreement in which she would have pled guilty to the dealing in cocaine charge and all the other charges would have been dismissed. A Class B felony conviction could have resulted in a 20-year prison sentence.
