Town pursues business compliance

In September, the Cloverdale Plan Commission approved plans for a new business under specific conditions, and they are prepared to enforce their terms.

Jeff Everman had approached the board in August and September with plans for Discount Tire, his proposed business.

The board approved the business under the stipulation that Everman follow some conditions, including completing a list the commission had composed at the September meeting.

The board had asked Everman to complete a fence structure around the business and that the area be cleaned up.

On Thursday, board president Jerry Acrea said Everman had been given 90 days for the completion of the requirements and that he had until Dec. 4.

Acrea suggested the commission draft a "courtesy letter" stipulating to Everman that he had until Dec. 4 to comply with the original agreement or the special exception would be revoked.

Board member Mike Gray motioned to draft the letter with Larry Fidler giving the second. The board voted in favor of the measure, 3-1, with board member Mark Cassida voting no.

"He needs to understand we're very serious," Gray said.

Meanwhile, the board approved a replatting of Stoney Ridge, a subdivision within Stardust Hills, that begins and ends at Lazy Bones Way, according to property owner Don Gedert.

Gedert approached the board Thursday with a plat that was approved last year by the plan commission, but it had excluded three lots.

He said he had recently acquired the titles for the lots and had the plat redrawn.

"It's a minor adjustment to a plat that had been previously approved," Gedert said.

The original plat had called for 52 lots.

Cassida said adding the lots would not make a difference to the plat in his opinion before motioning to approve the plat with the additional three lots.

Gray gave the second.

Board member John Davis was unable to attend Thursday's meeting.

In other business, the board:

* Received an update from Gray regarding the possibility of moving the Subway restaurant in the Interstate-70 truckstop outside of the building.

Gray said he had spoken to restaurant officials recently and reminded them of the town sewer ban. However, he said he recently spoke with Indiana Department of Environ-mental Management officials and they led him to believe moving the restaurant would not be a problem.

"But that's not in stone," Gray said.

Acrea asked Gray to remind the restaurant officials to submit plans for the move prior to the board's December meeting.

* Heard a proposal from Bill Howard regarding the old IGA building in Cloverdale. Howard said he was supposed to be added to the agenda but wasn't, so the board could not conduct business on the matter. However, Howard presented his proposal of wanting to establish a karaoke/music center in the building, that would include a concession stand. He said the building would be non-smoking and there would be no alcohol served.

Howard said he intended to clean up the outside of the building and little remodeling would be required.

Acrea suggested Howard come to the plan commission's December meeting with more information and asked Howard to pre-submit his plans for the building prior to the meeting.

The board of zoning appeals also met Thursday but did not conduct any business.

Both boards meet on the first Thursday of each month at Town Hall. The next plan commission meeting is scheduled for 7 p.m., Dec. 7, with the board of zoning appeals to meet at the conclusion of the first meeting.
