Child curfew considered at Fillmore

Wednesday, September 12, 2007

A local curfew is being considered by the Fillmore Town Council.

The first reading of a new curfew for Fillmore children age 17 and younger was heard by Fillmore Town Council members Margaret Alexander, Curt Leonard and Albert Epple on Sept. 8. The second reading will take place at the October town council meeting.

According to the ordinance, teenagers age 15, 16 or 17 are not allowed to be in public in the town between the hours of 1--5 a.m. on Saturday and Sunday; after 11 p.m. on Sunday through Friday; or before 5 a.m. Monday- Friday.

Children age 15 years or younger are not allowed to be in public in the town after 11 p.m. or before 5 a.m. on any day.

Exceptions to the ordinance apply to a child accompanied by a parent, guardian or custodian, or an adult specified by the child's parent, guardian or custodian or if they are participating in or coming or going to a job, school sanctioned activity or religious event.

Other exceptions include emergencies, religious activities, non-profit or governmental recreation, education training or care under the supervision or an adult or any activity that has the written direction of the child's parent or guardian.

Children violating the curfew can be fined and a complaint is filed with the Putnam Circuit Court. A penalty of up to $500 can be assessed to any parent or guardian of a child violating the curfew.

In other business, the council:

* Approved a 2008 budget of $93,450

* Granted permission for a path to be cleared for the fire department use during the annual barbecue fundraiser on Sept. 21 and 22.

* Approved Zachary Minnick as a reserve marshal for the town.

The next meeting of the Fillmore Town Council will be at 9 a .m. Oct. 6.
