Brazil man receives jail time for violation

Thursday, December 4, 2008

A Brazil man had a year of a previously suspended sentence reinstated Thursday in Putnam County Circuit Court.

Christopher Loughmiller, 23, was convicted of Class C felony burglary in Putnam County on Jan. 11, 2007. He was sentenced to four years with one year executed and the balance suspended. He was also placed on probation.

In July, Loughmiller was arrested in Clay County on a Class D possession of methamphetamine charge. He was convicted on Sept. 22, and sentenced to two years, all suspended except 180 days. He was also placed on probation for 18 months.

That conviction was a violation of the terms of his Putnam County probation.

Judge Matt Headley reminded Loughmiller, who refused a public defender when he first appeared in Putnam County Circuit Court on Oct. 30, that he still had the right to pauper counsel. Loughmiller said he wished to proceed without representation.

Loughmiller, who will receive credit for the 36 days he has spent in the Putnam County Jail, requested home detention.

"Not at this time," Headley said. "I'd like to see you go on to a meth treatment facility, and hopefully you can continue on from that."

Loughmiller's original burglary charge stemmed from a July 5, 2006 incident in which he drove the get away vehicle when two juveniles burglarized a Greencastle home. The home belonged to Loughmiller's then-girlfriend's parents, court documents said.
