Plea filed in meth case

A plea agreement has been filed for a Cloverdale man charged with Class A felony dealing in methamphetamine and Class C felony possession of methamphetamine over 3 grams.

A final pretrial conference for Michael L. Kolesar, 26, was held Thursday with Putnam County Senior Judge Diana LaViolette and Kolesar's attorney James Recker. Kolesar will be in court on Jan. 15 for a change of plea hearing. LaViolette also ordered that a pre-sentence investigation be conducted and a report on that investigation be filed before the hearing.

Under the terms of the plea agreement, Kolesar would plead guilty to the Class C felony and the dealing charge would be dropped. A Class C felony is punishable by up to eight years in prison.

Kolesar, of Cloverdale, was arrested July 11 after a traffic stop that produced more than 20 grams of meth. Kolesar was driving the vehicle, which belonged to Nancy A. Tarpley, 51, of Indianapolis.

Police found several baggies of crystal meth and assorted paraphernalia in the vehicle, court records said. A baggie of meth containing 3.4 grams of the drug was also located in Kolesar's front pants pocket.

Tarpley and Kolesar were both transported to the Putnam County Jail. On her way there, Tarpley said nearly $5,000 cash found on her person was to be used for buying and selling meth, and that she knew it was in the car, but that it belonged to Kolesar.

Kolesar has been in the Putnam County Jail since his arrest. His bond was set at $40,000 cash, and a bond reduction was denied on July 31.

On Dec. 4, Tarpley was convicted of Class C felony possession of methamphetamine over 3 grams and was sentenced to six years in prison with three executed and three suspended.

Kolesar's criminal past in Putnam County includes a 2002 conviction for felony theft and a litany of traffic violations.

  • Drop the "Dealing Charge"? Over 20 grams of Meth and $5000 in cash at the time of arrest, and Recker is going to help this man attempt to drop the "dealing" charge.

    What favors do we owe anyone who deals this poison to our community?

  • Yes,when you catch him red handed w/20 grams when "over 3" makes a felony,he has paraphernalia,and the dope is in selling bags,he has $5000.00 w/him...I'd say thats an open/shut case that should be prosecuted as is. Why would our judges NOT understand we owe them nothing. Sure in some cases,when you have to get help from the criminal to open the overall case,then plea if needed. In open shutcases,no.tell me a judge dosent understan meth and its grip on people,their families/children. Do the judges realize this dealer(the worst offense,of the two!)is supplying people w/this meth..Offer a plea and accept it and dole this level of consequence? It doesnt make sense.

  • if you don't know how the legal system works, then maybe you should learn before you make a comment. Do you tell your surgeon how to your infected gall bladder? First, prosecutors, not judges, make plea offers to the defendants. Second, if prosecutors did not offer plea agreements, then every single case would be tried. A strightforward jury trial takes at a minimun of 2 days. The legal system would collapse because of all of this, unless you are willing to build 10 new courts. It sounds great to say don't let anyone have a plea agreement. But then think about it...before you write a comment.

  • Whoever is writing this stuff in the paper, you don't know what you are talking about; none of you know what you are talking about. There was no trial Thursday and there was nothing. I was there and they took him back to jail. Wow all of you people just keeping talking and running your mouth. We don't give a care what you think of him and some of you people don't even know him. So keep talking and we are going to help Kolesar out for sure. He his getting railroad for something that was not even his and it was not is vehicle either. We are going to get him out and we are going to tell everyone the truth and facts. I don't care what you think of him, I don't care what you think of me, and I sure don't care what you think about my family. My family is good people, so keep talking all you want, because this family is strong and we fight for things that are not right…

    The story does not say there was a trial. It says there was a hearing and that a date was set.

  • Well basher, then I am for building 10 more courts! Then 20 more prisons. I'm for whatever it takes to rid the streets of people who choose to be a part of this plague called Meth.

    I'll always be shocked to read of prosecutors offering plea bargains like the one in this story. This isn't shoplifting, or breaking an entering, this is a story of 2 peopole in one vehicle, with dealer quantities of cash and multiple grams of meth.

    Sorry about your luck Christine, your friend chose to dance with the devil and now his shoes are on fire.

    I don't want to sound mean here, but........alot of us do know Michael and the rest of the family....you say you are going to help him and prove his innocence, and get him out, but honey.........where are ya gonna get that kind of money? None of you have that kind of cash. Well, ok maybe your brothers might, but........well enough said there. Michael needs help, and he is where he belongs. It's time the drug dealers, sellers and otherwise were put off the streets and stopped being slapped on the wrists for these senseless,acts of stupidity.

  • No, he has no 2002 conviction for felony theft; all of those tickets are paid for, done with, and out of the way. So I don't know where you people are getting this stuff, but it's not true. Yes, he will help anybody out that need it, even if it's a stranger, that's what you people don't know about our family. I like how you people think you know this family, well you don't. Why don't you people keep you nose out of my family's business and do something with your own life, instead of butting in ours?

  • Your family is the one the paper is reporting about - and also reported about the 2002 felony theft conviction and tickets. Read the last line of the article. So, possibly the reporting is wrong ?

    I'm not judging you or your family, but I am one of the many in the community who are sick of the meth and other drug pushing that's going on in the area. It's way out of control, and something needs to be done about it.

    It's nice that your family will help out those in need, but in doing that you have to watch out who you are helping. Not everyone is honest. Some will take advantage of you if you appear gullible - and when they get caught - will take you down the drain with them.

  • Like I said, you people don't know this family, so get your facts straight. My parents are not in good shape and Michael was here to help the family out. Yes, he's not perfect, we are not perfect, and I don't know a person that is perfect around here. He has no felony; he has a misdemeanor, that's to all the people that think you know him… Wow don't you people have anything better to do then gossip about every little detail that goes on up here. My family is good people and we haven't done anything to you people or this community. So, stop judging us, it's done with, and keep your nose out of my family's business. As for mad-mom you don't know us either, so stop spreading rumors that aren't true, and yes my family is good people. You people don't know what this family is going through, none of you know! So leave this whole family alone…! If you have anything to say about us, then say it to our face…!

  • Christine, I was not spreading rumors,I was stating what the paper said. I was suggesting to you that you need to go to the Court House and see if maybe you are being lied to. People on the wrong side of the law tend to lie more then they tell the truth including to loved ones. It is a possibility he hasn't told you everything and does have a felony.

    Consider this, stop reading the paper until this all blows over, you are getting yourself worked up for nothing and will never change anyone's minds.
