Buis charged with voluntary manslaughter

GREENCASTLE -- A Van Bibber Lake man was formally charged in Putnam County Circuit Court Thursday with a Class A felony count of voluntary manslaughter.

Matthew Buis, 39, stands accused of shooting to death Clifford Hulse, 57. Hulse was killed Tuesday.

In court Thursday, Judge Matthew Headley explained to Buis that a Class A felony carries an advisory sentence of 30 years in prison, a minimum sentence of 20 years and a maximum sentence of 50 years.

When Headley asked Buis if he remembered being read his rights at the time of Buis' arrest, Buis said he did not. As Headley began to read a document that had been signed by Buis that outlined those rights, Buis interrupted Headley and said he in fact did remember.

Headley asked if Buis wanted a preliminary not guilty plea entered by the court on Buis' behalf.

"Yes I do," Buis said. "All I did was in self-defense, your honor."

Headley told Buis that was a matter he would need to discuss with his attorney.

Buis requested pauper counsel. He told Headley he has no money saved, no property to convert to cash and is currently unemployed.

Headley appointed Todd Sallee to represent Buis, and set a pretrial conference for June 10.

Per the request of Deputy Prosecutor James Hanner, Buis' bond was set at $100,000 cash only.

According to court documents, Buis and Hulse were neighbors that lived across the street from one another.

An eyewitness told police he had been playing cards with Hulse and another man before the shooting occurred. He said Buis arrived about 2 a.m., and that Buis and Hulse began arguing some time later.

Hulse ordered Buis to leave. Buis refused, the witness said, and when Hulse stood up to face Buis, Buis pulled a handgun from his pocket, court documents said. Hulse picked up a filet knife from a picnic table, and Buis fired a shot in the air over Hulse's head.

Buis fired a second shot almost immediately, the witness told police, and Hulse was struck and fell to the ground. The witness said Buis shot at Hulse from approximately 15 feet.

The witness told police Buis did not leave after shooting Hulse, but approached the witness in a threatening manner and threatened to "shoot him too."

At that point, Buis' roommate came over and ushered Buis home, court documents said.

At 3:06 a.m., Putnam County 911 received a call about a man shot with a gun. When officers arrived at the scene, a man and a woman were performing CPR on Hulse, court documents said.

Hulse was pronounced dead at the scene. Officers found the gun allegedly used in Hulse's murder in Buis' front yard.

Buis was interviewed shortly after the incident. Buis told police Hulse had accused Buis of bringing him bad luck in cards, and that was when Hulse, unprovoked, grabbed the knife and brandished it at Buis.

Buis said he attempted to leave the garage, but got tangled in a tarp. He told police he "saw Hulse approaching him face-on with the filet knife in his hand and holding it over his head as if to strike down with it."

Buis said he "feared for his life," and fired one shot, striking Hulse.

"Buis was insistent about firing only one shot," court documents said.

According to court documents, however, police found a bullet hole in the rear wall area of the garage, supporting the witness' allegation that a shot that missed Hulse was fired.

The witness also told police Buis was not attempting to leave the garage when the shooting occurred.

An autopsy report listed the cause of Hulse's death as a single gunshot wound to the mid-chest. The bullet struck an artery and Hulse bled to death.

Other witnesses told police they heard the gunshots and heard Buis "yelling angrily."

  • The story continues, but what is sad, is that 2 lives are wasted, plus many more have been hurt. All of us need to be thankful that we have not been in this type of situation. My prayers continue to go out to all who have been impacted by this event and to the Court as they address this case. May God bless everyone.

  • yes it is a sad story,and even sadder is both whitnesses were drunk and have conflicting stories,i sincerly hope to God that the real truth comes out,and everyone gets closier and that vbl and all of americe can learn a lesson from this tragic event ,may GOD help us all,HE is comming soon

  • I don't know either of these men or anyone who has so freely added their commentary under cover of being anonymous. As always, I am absolutely amazed by the bravery and boldness of what those who know that we don't know who they are will say.

    Our community has suffered yet another tragedy. We need to pull together and help one another so that no one else becomes so desperate as these men.

    Jesus himself said "Come to me, all you who are weary and burdened, and I will give you rest."

    If you are a Christian, pray for peace and forgiveness for us all, especially the families hurt by this tragedy. If you are not a Christian, find a church in your community and go there on Sunday. I know that God will welcome you.

    Mine is Big Walnut Baptist Church in Reelsville and our Sunday Services start with Sunday School at 9:30, followed by Church at 10:30. All are welcome.

  • Yes,two lives(or more)have forever been changed,this is truly sad days for humanity!But we must not forget,the man shot was in his home(garage if you want to be technical)the man aledgely doing the shooting was an unwelcome vistor and brought a gun,to me this shows he came expecting trouble and refused to leave when asked to do so,so the story goes.I hope the courts see this and reacts accordinly to what the FACTS show.

  • lowsulphur Amen....But this is Greentucky...and you cant expect much more from some here....Lets take a trip back to last summer cliff & matt spent most of that summer riding around on a golfcart together drinking talking laughing

    the reason i bring this up is it was said that the fued had been going on for years....The fued as it has been called seemed to have started when someone mistreated someones mom...at least thats one of the rumours at the lake and there are many

    fact of the matter is the one poster on here that is so happy about matt getting his due was known many times to be at matts house (Having a goodtime)but from what i heard matt had to put a stop to to that poster comming over because all they wanted to do was sponge off matt and cliff...again this is a story i heard...it just gets me when ppl are so quick to jump on a bandwagon or lynch party...Bottom line is Two lifes have been lost here.Both familes are sitting around numb scared hurt and both sides have come to these boards and seen what has been posted...justin even ask that they need not post and to please stop that they wernt there...even then mans son doesnt get any respect from teh poster...heartless people....Let the courts sort it.Its not for us to Judge...you can have your opinon but in this case keep it to yourself..show some tact...as one poster said on a diffrent site vbl=mudpeople im starting to believe it! You want to be the voice of your community why dont you get out and set up a sign that ask people to honk and pray for both familes at the entrance to the lake we all have enough to worrie about...incase anyone has forgotten the Methlabs back here are starting to overrun the park lets do something about them..enough said last post i make god be with both the Hulse's and the Buis's

    My heart is broken (as are many) for these families and I'm sure they would appreciate the prayers of the community.

    Peace and healing come from loving actions, not hurtful words.

    If one comment I make helps ANYONE in this situation to heal or to accept Christ, I've done my job. So your persecution doesn't matter to me anymore than my faith matters to you.

  • @indyboy123....you are right i did hang out at matts house and matt was my friend until he shot and killed cliff who was also my friend. I will not stick up for or be friends with a murderer!! This is the last thing i also will post. and i am praying for the families of both parties involved.

  • I am the unidentified woman in the garage who attempted to do CPR on Cliff Hulse the night this happened. I am also the owner the property where this happened. I am also the mother of the victim's son. Please try to respect my son and the families of both sides of this most unfortunate incident and hope that justice will be served. You can help everybody by praying for the lost.

  • I am the unidentified woman in the article who attempted to do CPR on Cliff Hulse that morning. I am also the property owner where he was killed. I am also the mother of the victim's son. Please have respect when you are talking about what you no nothing about and let justice prevail. Pray for the families on both sides of this unfortunate situation.
