GREENCASTLE -- A Roachdale woman who stole over $55,000 from local special education cooperative Old National Trail has been granted release into a community transition program.

Tammy Y. Mitchener, 34, has been in prison since July 2009. She was convicted of stealing funds from ONT, where she was employed as a treasurer. She was convicted of one count of Class C felony corrupt business influence (also known as racketeering) and one count of Class D felony theft.

Mitchener was arrested on Dec. 2, 2008. Later that day, a family member posted 10 percent of a $10,000 bond and Mitchener was released.

According to court records, Mitchener wrote $56,639.19 worth of checks from the ONT's account to a vendor called PC Technologies, which turned out to be a dummy corporation she set up and opened a bank account for.

Mitchener deposited the checks she wrote into the PC Technologies account and then moved the money into her personal account, which was at a different bank, using online banking services.

Judge Matthew Headley gave Mitchener a five-year sentence and ordered Mitchener to serve years in prison and spend two years on probation. The maximum sentence Headley could have given Mitchener would have been 10 years.

Mitchener has been serving her prison sentence at the Indiana Women's Prison in Indianapolis. Her earliest possible out day is listed on the IDOC website as Jan. 21, 2011.

Mitchener's approval for the transition program means that while she will technically still be a Department of Corrections inmate, she will be released from prison. She will either be put on electronic home monitoring or work release.

This was the second attempt to get Mitchener out of prison.

Mitchener's attorney, Bob Perry, filed a request on Nov. 4, 2009, to ask that his client be released into home detention. The state objected to the request, and it was denied by Headley on Nov. 17, 2009.

  • I pray that the courts let her son live with her. I attend all the school functions and to watch his father and the way he portrays himself is a shame and no child should be in that enviroment!

  • and just what kind of environment would that be greencastle86 I attend all the sporting events he's in too and his dad seems just fine! another thing what kind of environment did she create herself one that got her locked up? seems like she's a good role model for him! so before you post things maybe you should take a look at all that has went on. oh wait you probably don't know what your even talking about! by what I hear he removed him from two bad environments! plus maybe you should talk to him and see what really went on!!!!

  • This is a travesty, she obviously has no morals or feeling stealing from special need kids. Thanks to her the program is disbanned here, send here to alcatraz for the remainder of her time, what a joke put co. prosecuters.

  • Dont committ the crime if ya dont want to do the time. She got what she deserved. As for her parenting skills and the fathers parenting skills, it sounds like they are tit for tat. Dont know them personally so cant say one way or another, but Mom get locked up makes me wonder about her.

  • In my opinion both parents are guilty. You can't tell me a spouse is stealing from their employer and the other spouse don't know it or at least don't suspect something fishy. I am sorry but, if I had extra money I would want to know where it was coming from.Don't understand why she doesn't have to do at least half her time. Time cuts usually don't work that way.

  • Wow. Regardless of what we all think about Tammy and her son's father, I'm sure her son feels really proud to read what you're posting about his parents. Please remember, he's a kid. He has to go to school and try to live a "normal" life and still try to sort through all of this. Take it easy. God bless him and her other children, as well.
