Sutherlin to plead

Thursday, December 4, 2008

Sentencing for a Greencastle man facing a felony drug charge has been set.

On Thursday, Judge Matt Headley set sentencing for David Sutherlin, 36, for Jan. 15. Sutherlin was originally charged with Class C felony possession with intent to distribute and Class D felonies possession of marijuana and possession of a controlled substance. Under the terms of a plea agreement Headley took under advisement, Sutherlin would plead guilty to the possession of marijuana charge and the other counts would be dismissed.

A Class D felony is punishable by up to three years in prison.

Sutherlin has no prior criminal offenses or convictions on his record. He was arrested May 14 after a raid that yielded explosive devices and drugs.

It was determined that Sutherlin stole the materials for the devices from Sky Magic Pyrotechnics Inc., Brazil, where he was a volunteer. Sky Magic representatives declined to press charges against Sutherlin.
