Subway renovations set to begin in Cloverdale

CLOVERDALE -- The town of Cloverdale recently got some welcomed news as the Subway restaurant, which has stood closed for quite some time, has been purchased. However, renovations to the building have since been put on hold due to an issue with plat records, which forced the Cloverdale Town Council to hold a special session on Tuesday evening.

The council convened earlier this week with the goal of resolving the issue of the plat, which through some research by Town Attorney Allan Yackey and Clerk-treasurer Cheryl Galloway, was found to have previously been approved by the planning commission in 2006, but was never recorded.

"This is a prime example of what happens when people disregard the rules," Yackey explained. "What appeared to have happened, is rather than following the law, the planning commission in 2006 and 2007 was acting like it was a kingship. (When the new owners went to Abstract and Title) there was no plat on file, which creates a problem for lending and it creates a problem for title insurance."

Without the proper documents recorded, the new owners have since been unable to proceed with renovations to the building, which caused the council to scramble to find a paper trail from when the building was first constructed.

"Sometime after the planning commission approval, for some reason, somebody realized that there was nothing recorded," Yackey explained. "So, what they did was simply record a survey that appeared to have been taken sometime in 2006, which effectively is a plat. They recorded it, but there is no official approval of the plat."

With the previous owners having operated for many years on the instructions of the town, regardless of things not being officially documented, the town council chose to retroactively approve Resolution 2014-11, which states what they have recently found while searching for records, which thus documents the plat allowing work to now begin at the Subway location.

  • Easy, there. It's Mr. Yackey who is taking the low road. The paperwork was easy to correct. These things happen. Too bad the Town continues to hire such a classless act. For the money he makes, he could afford to speak a bit more gently.

    So the issue is resolved and Subway returns! Congrats to the new owners!

  • i have a question that i am sure somebody can answer. we all know most of our businesses are now owned by foreigners. i have heard that they get a 7 year tax break or no taxes. so, subway and wendys both closed last year. if these were took over by the foreigner in 2006, 2013 would have been the last year of the tax breaks and they closed the businesses. the truck stop does not have diesel gas, and its a truck stop. why would anybody be able to come to our country and buy everything up and not have to pay taxes? they obviously have money, they are obviously making money at the new business but America doesnt want their tax money. i dont understand
