Wagley told deputies Matt Biggs and Anthony Brown he was in the right lane with the cruise control set between 60 and 65 mph when he was struck from behind, pushing him off the road.

Avila told the deputies the pickup was "traveling slow." Asked why he didn't slow down or change lanes, Avila would only respond that the other driver was traveling too slow.

Avila was issued a citation for following too closely.

Both vehicles were towed. Damage was estimated at $10,000-$25,000.
