Former Greencastle man gets 25 years

BRAZIL -- A 47-year-old former Greencastle man has been sentenced to 25 years in prison for attempted burglary in a September 2015 Clay County case.

Kevin E. Terry, whose Putnam County criminal record has included a variety of court appearances for such indiscretions as criminal mischief, possession of marijuana, possession of paraphernalia and alcohol-related issues, was sentenced for attempting to break into a female's Brazil residence, threatening the victim and using a machete to damage her car.

Last month after a three-day trial, a Clay Circuit Court jury found Terry guilty on felony and misdemeanor counts of attempted burglary, attempted residential entry, intimidation, criminal mischief and possession of methamphetamine.

However, he was acquitted of the most serious allegation against him, a Level 1 felony count of attempted rape.

Clay Circuit Court Judge Joseph Trout sentenced Terry to 25 years on the Level 2 felony count of attempted burglary, giving him concurrent sentences for the other convictions. The attempted residential entry count was vacated on "double jeopardy grounds" and merged with Terry's attempted burglary conviction, according to court documents.

The trial stemmed from an incident that unfolded at 1:50 a.m. Sept. 30 when a frantic female called Clay County 911, reporting a shirtless Terry -- carrying a machete and accompanied by a pit bull -- was trapped inside her attached garage and trying to get into the residence.

Terry reportedly made alleged sexual and intimidating comments to the victim while using the machete to damage the hood of the homeowner's vehicle before two Brazil police officers arrived to find him standing in the garage.
