Maj. Dwight Simmons initiated the stop and quickly noticed Burnett acting nervous. Simmons called for backup from Deputy Jacob Harrington, later utilizing K9 narcotics detection officer Bo, who indicated the presence of narcotics.

Inside the pickup truck, Simmons found a zip-lock baggy containing a crystal-like substance inside a styrofoam cup.

Burnett was placed under arrest and transported to the Putnam County Jail.

The substance field tested positive for methamphetamine and was discovered to have a weight of 116 grams or about four ounces.

Due to this amount, Burnett was preliminarily charged with Level 2 felony dealing in methamphetamine (at least 10 grams) and Level 3 possession of methamphetamine (at least 28 grams).

When the Putnam County Prosecutor’s Office filed official charges on Monday, it was only for the Level 3 felony possession charge.

Burnett had his initial hearing Monday before Superior Court Judge Denny Bridges, who entered a not-guilty plea on his behalf. The judge set his bond at $25,000, cash only.

The defendant was already out on $10,000 bond from a January arrest in which he is charged with Level 6 felony possession of methamphetamine, Class B misdemeanor possession of marijuana and Class C misdemeanor possession of paraphernalia.

Besides these charges, Burnett also has pending Putnam County cases for misdemeanor charges of driving with a suspended license and criminal mischief.

In 2010, Burnett was also found guilty of Class C felony burglary.

Burnett’s latest case is currently set for a Jan. 30, 2018 jury trial.

A Level 3 felony is punishable by 3-16 years in prison and a fine of up to $10,000.
