Six charged in Cloverdale fight do not include alleged shooter

A shooting during a melee at a Cloverdale bar last month led to preliminary charges against seven people.

However, the shooter is not among the six people ultimately charged by the Putnam County Prosecutor’s Office this week, as she is saying she acted in self defense when she and her male companion were allegedly attacked by several others.

The trouble began inside the Red Roof Bar at 5 E. Market St. when Zachary Davis, 36, Cloverdale, and Michael Floyd, 31, Centerpoint, were arguing over who could hit the hardest in a punching bag game in the bar.

Cloverdale Deputy Marshal Daniel Warren notes that video from the bar showed Floyd and fiancée Marsha Denis, 40, Indianapolis, standing by the exit doors backing out of the bar. At this point, Davis is seen rushing Floyd in between the doors and punching him in the face.

Video further shows Austin Perdue, 22, Cloverdale, joining the fracas, also swinging at Floyd with closed fists.

The fight was broken up temporarily and Floyd and Denis continued outside. Warren noted that Floyd’s face was covered in blood as he walked to his car.

However, Davis is again seen rushing Floyd and resuming the fight, with Denis and Sierra Miller, 36, Poland, attempting to separate them.

Afterward, Miller was being held by Brian Wallace, 21, Cloverdale, and Ivy Smith, 22, Quincy, but she managed to reach out and punch Floyd, after which she began walking toward Denis.

At this point, Denis appeared to have tripped over the curb and landed on her back.

There is no actual video footage of the shooting, though Miller can be seen walking back toward the bar holding her chest.

During this same time period, both Wallace and Smith can be seen pushing, and in Smith’s case also punching, Floyd.

Denis and Floyd had left the scene by the time Warren arrived, though he found Miller lying on the pool table receiving treatment from bystanders who were medical personnel.

As Warren and Putnam County sheriff’s Deputy Randy Patrick were investigating at the scene, a call came in from Floyd and Denis, who were at the Cloverdale Econolodge. Sgt. Riley Houhton and deputies Derek Line and Rober Soilleux of PCSO, along with an Indiana State Police trooper, responded to the scene. At that time, Floyd told police he was trying to leave and felt he was “getting jumped.” Denis admitted to shooting Miller, claiming self defense.

The bullet ultimately traveled all the way through Miller’s left shoulder/chest area and she had to spend the night in an Indianapolis hospital.

While Denis faces no charges, all other participants face some degree of charges, which include:

• Zachary Davis: Level 6 felony battery resulting in moderate bodily injury, Class B misdemeanor disorderly conduct;

• Michael Floyd: Class A misdemeanor battery resulting in bodily injury, Class B misdemeanor disorderly conduct;

• Austin Perdue: Class A misdemeanor battery resulting in bodily injury, Class B misdemeanor disorderly conduct;

• Sierra Miller: Class A misdemeanor battery resulting in bodily injury, Class B misdemeanor disorderly conduct;

• Ivy Smith: Class A misdemeanor battery resulting in bodily injury, Class B misdemeanor disorderly conduct; and

• Brain Wallace: Class B misdemeanor battery; Class B misdemeanor disorderly conduct, Class B misdemeanor possession of marijuana.

During a pat down, Wallace was discovered to be in possession of marijuana and a smoking device that he told police were Davis’ and had been handed to him.

Davis and Smith each made their initial appearances before Putnam Superior Court Judge Denny Bridges on Wednesday. Not guilty pleas were entered in each case.

Meanwhile, Floyd, Perdue, Miller and Wallace are all set to appear in Putnam Superior Court on Dec. 1.

    Why is Mr Floyd being charged with anything?

    According to both articles I have read, he was trying to leave and was attacked.

    If he engaged his attacker in order to stop the threat against him, that is self-defense.

    Shooter claims self-defense (rightfully so) and no charges are brought.

    But b/c Mr Floyd was throwing fists that is somehow less acceptable as a claim of self-defense?

    Shame on the Putnam County Prosecutor's Office.

    If it were not for the actions of Mr. Davis and his friends, there would have been no violence at all.
