Child pornography charge against Reelsville man dismissed

Charges have been dropped in the case of Reelsville man accused late last year of possessing child pornography.

Blake Hopper, 39, was freed from the Putnam County Jail on March 7, the day after the Putnam County Prosecutor’s Office filed a motion in Putnam Circuit Court to dismiss the Level 5 felony charge of possession of child pornography against him.

Hopper had been in jail since early January.

Chief Deputy Prosecutor Austin Malayer told the Banner Graphic there were problems with investigators being able to get a physical download of Hopper’s electronic device due to a damaged port. Additionally, the chat room on which the offending video was allegedly sent only retained data for 30 days.

Charges were dropped, according to Malayer, because prosecutors could not prove Hopper “knowingly and intentionally” possessed the video.

  • If prosecutors had possession of the "electronic device" I hope they did everything possible to retrieve the data and didn't just give up because of the damaged port.
